Posse IP Pty Limited ACN 131 776 540 is the owner and operator of the Posse.com website ("Posse") and respects each individual's right to personal privacy.

This privacy policy covers Posse's treatment of personally identifiable information such as your name, address, email address, or phone number and other such information that is not otherwise publicly available information ("Personal Information").

It also covers any information collected or received by Posse in relation to any purchases or your use of any Posse services ("Services"). This policy is limited to the procedures and systems that Posse owns and/or controls and to the activities of its officers and employees. This policy does not cover the practices of any third party outside of the employ or control of Posse.

Information Collection

The primary purpose Posse will collect Personal Information is to supply customers with the products and services requested from it and its related companies. Other secondary purposes include:

1. billing and account management;
2. business planning and product development;
3. to provide you with information about promotions, as well as the products and services of Posse and affiliated companies and other organizations; and
4. to enhance your service experience when using Posse by displaying products and/or services that match your personal preferences based on their previous website browsing history and/or buying activity.

Posse may collect Personal Information when:

• you register as a user of any Posse Services;
• a page of the Posse website is visited;
• any page related to the content contained within the Posse website is visited (e.g. Posse may combine information about you along with information obtained by Posse's business partners or other companies).

Posse will not collect Sensitive Information except with your consent and only if the collection of such information is necessary for an activity or function.

Registration information will primarily include information such as your first and last name and email address, but in certain circumstances your address or other information will be required in order to assist Posse to, when applicable, contact you or to provide goods or services to you.

If you register and subsequently sign in to use Posse's Services all such use will no longer be anonymous and Posse will collect information about your transactions with Posse and your use of Posse's Services. This information may be used to tailor our presentation of information, ads or offers to you or for other purposes. The use of that information may enable us to give you additional information on your favorite music, bands, events or even special promotions.

Posse automatically receives and records information from your browser (such as your IP address, browser settings, and pages requested) on our server logs.

Posse collects this information in a variety of means including providing forms for you to enter information as well as gathering information about your general activity on the site. The information is collected both voluntarily and involuntarily. To receive our products and services, email address, first and last name and certain other fields are mandatory because they are required for the setup of your store and to allow you to get paid commissions. Other information we request is optional.

Posse may also collect information which you divulge about other people, in the process of making referrals or gift purchases.

Advertising appearing on the Posse site may also collect anonymous information.

Widgets or other applications created by third party developers may also be available on the Posse Services. Posse does not control the development or use of such software and if you choose to use such software you are engaging with the third party developer, not with Posse. We encourage you to not provide personal information to such third party's or to use their applications unless you know the third party you have confidence in their products and services.

If you click on links to any other websites, we encourage you to read the privacy policies of those linked websites as their privacy standards may differ.

Some membership information that you have provided to Posse (such as your full name, email address, school or company) may be publicly viewable to assist you and other users to locate each other and connect on Posse. Please edit your profile if you wish such information to be restricted or kept private. Of course, search engines may also be able to access displayed information.

Posse may periodically send you promotional materials such as newsletters if you have consented to receive such material. Please notify us if you no longer wish to receive such information. You can notify Posse of your decision by either changing your user preferences under the "Edit My Profile" tab (or equivalent) or by clicking the "unsubscribe" link at the bottom of each email.

Posse does not actively market to children, and we never knowingly ask a child under 13 to divulge Personal Information.

We strongly recommend that minors between the age of 13 and 18 seek the consent of a parent or guardian before providing any information to Posse or using any commerce-related services or tools on the Posse website.

Information USE

Posse uses information to:

• fulfill your product and service requests;
• provide you with product and service information, email announcements, special deals, newsletters or advertisements, but you will have the option to not receive these types of communications;
• create customer profiles based on browsing or purchasing history or to supplement information collected at Posse with data from other sources [such as credit history to authorize purchases];
• improve Posse's Services; and/or
• contact you, conduct research, and provide anonymous reporting for internal and external clients.

Posse will not use Sensitive Information for Direct Marketing purposes or for any other purpose without your approval. In some circumstances Posse may use non-sensitive Personal Information to enable Direct Marketing to individuals on the basis that:

• you will be clearly notified of your right to expressly request an exclusion from any further Direct Marketing ("Opt Out");
• you will be given the option to Opt Out from any further Direct Marketing; and
• if you Opt Out of all Direct Marketing your decision will be respected by Posse and all its Related Body Corporate.

Information Sharing and Disclosure

Posse may disclose Personal Information to a Related Body Corporate or an unrelated third party if your consent has been.

Posse does not rent, sell, or share Personal Information about you with other people or non-affiliated companies, except to provide products or services you've requested. Such disclosure will be limited to when we have your permission or when such disclosure is within your reasonable expectations.

The other exceptions will be when Personal Information is disclosed:

• to a trusted partner who works on behalf of or with Posse under confidentiality agreements ("Service Partner") or to billing, customer relations management, credit card, order fulfillment or shipping companies in order to provide goods or services to you;
• to a Service Partner who requires access to your Personal Information to help Posse communicate with you (but a Service Partner will not have an independent right to share Personal Information or to contact you regarding any matter not related to Posse);
• as required under a subpoena, court order, or legal process, or in order to establish, exercise or defend Posse's legal rights;
• in order (in the reasonable opinion of Posse) to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Posse's Terms of Use, or as otherwise required by law; and
• in circumstances where Posse is acquired by or merged with another company (in which case Posse will give notice that such information is to be transferred and will become subject to a different privacy policy).

Cookies

Posse will set and access Posse cookies on your computer and also requires a non-persistent cookie, used only to keep track of your login status. A cookie is a small text file that our web server places on a user's computer hard drive to be a unique identifier. Cookies enable Posse to track usage patterns and deliver customized content to users. Our cookies do have an expiration date. Our cookies do collect personally identifiable information. Posse will store your email address or username in a cookie so that when you return to the site after logging out we can automatically display it to you.

Changing Information and Preferences

You are entitled to access any Posse records that contain your Personal Information.

Posse will at your request correct as soon as reasonably possible any Posse records that contain your Personal Information.

Although Posse may charge a fee for a complex or resource intensive change, there will normally be no fee charged for processing an access or correction request.

You can lodge a request to access and/or correct your Personal Information, edit your account information at any time or cancel your membership by contacting support privacy@posse.com.

Conditional Us

Your use of Posse is conditional on your acceptance that:

• Any material you post on the website (including in a chat, message board or forum) will be publicly displayed and it may not be possible to subsequently delete or remove such material;
• Any material you may have contributed to Posse may remain in some form on the site even after you cease to be a member; and
• Receiving certain communications from Posse (such as service announcements and administrative messages) is a condition of Posse membership

Access by Posse's employees to your Personal Information will be restricted to circumstances where we reasonably believe such access is needed in order to provide products or services to you or for operational purposes.
