Posse privacy policy

Posse Holdings Pty Limited ABN 131 776 531 ('Posse') operates www.posse.com. The services offered by Posse include any Posse-branded URL (Posse Website) and any other features, Content (as defined in the Terms and Conditions of Use), software, code or applications offered from time to time by Posse via or in connection with the Posse Website (collectively, the Posse Services).

The Posse Services are hosted in the United States and other locations determined by Posse at its sole discretion. From time to time, we may transfer your personal data for internal business purposes to locations outside the United States or European Economic Area, some of which may have different data protection laws, or no data protection laws. We shall only transmit such information to entities that comply with suitable policies.

This policy details how Posse uses and protects personal information it receives, including information about your use of the Posse Services. Posse is committed to protecting your privacy. Information you provide while using the Posse Services will be used only in accordance with this policy.

Posse may update this policy from time to time by updating this page. We will notify you of significant changes to this policy by sending email to your account email address or by placing a notice on this web site.

In order for Posse to provide the Posse Services it must collect information from you. This policy applies only to the Posse Services and to the activities of Posse’s officers and employees. This site does not extend to third-party sites linked from the Posse Services and Posse does not control the collection or use of personal information collected on third-party sites.

1. Information we collect

When you visit the Posse Website you may provide Posse with two types of information: ‘personal information’ you knowingly choose to disclose that is collected on an individual basis and ‘website use information’ collected on an aggregate basis as you and others use the Posse Services.

Posse may as a result of your interaction with the Posse Services hold and process personal information obtained about you when you access the Posse Services and use it for servicing our relationship with you, for the purposes of fraud prevention, to conduct our business and to provide you with better customer service and products from Posse and those of selected third parties, to evaluate the effectiveness of our marketing of the Posse Services and for statistical analysis.

Posse will not collect sensitive information except with your consent, and then only if collection of such information is necessary for some activity or function. For the purpose of this policy, ‘Sensitive Information’ means health information or information or an opinion about an individual's:

  1. racial or ethnic origin;
  2. political opinions;
  3. membership of a political association;
  4. religious beliefs or affiliations;
  5. philosophical beliefs;
  6. membership of a professional or trade association;
  7. membership of a trade union;
  8. sexual preferences or practices; or
  9. criminal record.

Personal Information

  1. Posse identifies you by an email address and a password, or with your permission by reference to your identity on another web service such as Facebook. You may also provide further identifying information such as your name, geographic location, and a picture of yourself.
  2. If you connect another web service with your User account you permit Posse to collect and store information about you made available by that web service.
  3. During your interactions with Posse you will be invited to provide information about bands, festivals, venues and other people or brands with which you wish to affiliate.
  4. In order to receive or provide payments from or you, Posse may collect information and account details enabling such transactions, and details of those transactions, such as a record of products you have sold.

Website Use Information

  1. Posse records information about your interactions with the Posse Services, and with Posse-hosted Content embedded in third party web sites. Posse servers automatically receive and log information from your browser, including your IP address, browser configuration, the page or information you have requested and the date and time of your request.
  2. Posse utilises “cookies” which enables it to monitor traffic patterns and to serve you more efficiently if you revisit the site. A cookie does not identify you personally but it does identify your computer. You can set your browser to notify you when you receive a cookie and this will provide you with an opportunity to either accept or reject it in each instance. If you disable cookies, the Posse Services may not function properly.

2. How we use collected information

Posse uses the information you provide in order to identify you, communicate with you, and provide personalised services. You may choose to remain anonymous to Posse by withholding identifying information, refusing offers to connect with accounts on other web sites (such as Facebook), and/or making use of a third-party email provider.

If you choose to decline to provide certain personal information to Posse, in accordance with the Terms and Conditions of Use, Posse may not be able to provide you access to the Posse Service.

Our use of collected information may include:

  1. sharing information, including information that is not publicly published but excluding Sensitive Information, with other Posse Users, including bands, festivals, venues and other people or brands with which you wish to affiliate;
  2. sharing aggregate information with third parties which does not personally identify you.
  3. providing customised services to you, including selection of content and advertising;
  4. contacting you, including with promotional materials and notifications;
  5. billing and account management;
  6. research and development in improving our services and in developing new products and services; and
  7. monitoring and maintaining our computers and network.

Posse will not sell or otherwise provide your personal information to a third party, or make any other use of your personal information, for any purpose which is not incidental to your use of the Posse Services. For the avoidance of doubt, personal information will not be used for any purpose which a reasonable person in your position would not expect.

If you request Posse not to use personal information in a particular manner or at all, Posse will adopt all reasonable measures to observe your request but it may still use or disclose that information if Posse:

  1. subsequently notifies you of the intended use or disclosure and you do not object to that use or disclosure;
  2. believes that observing the request will legitimately inhibit Posse’s ability to provide the Posse Services;
  3. believes that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for government or public security in the performance of their functions; or
  4. is required by law to disclose that information.

Personal information collected by Posse will be used only for purposes outlined in this policy. If Posse proposes to use your information for any other purposes then you will be provided with a means to opt out of the use of your information for those purposes. You may opt out of receiving promotional materials from Posse but cannot opt out of receiving certain communications from Posse (such as service announcements and administrative messages) as it is instrumental to providing the Posse Services.

You can view and edit your Posse account information at any time by visiting your account settings page. You can delete your Posse account at any time, which will remove all personal and identifying information from our service, except as required to be retained by law or for legitimate business purposes. Some information may reside on backup devices for a limited period of time after your account is deleted.

3. Information sharing

Posse is designed to allow you to share information about your affiliations with brands with others. Some information you provide to Posse is made publicly available and may be accessed by anyone on the Internet including, but not limited to:

  1. your name;
  2. your profile;
  3. a profile picture;
  4. your approximate geographic location;
  5. links to your accounts on third party web sites;
  6. information about sales you achieve; and
  7. content you provide to Posse, including posts to forums or message boards, images, audio, or video files.

Your contact information, including your email address, is not made available to anyone unless you provide express consent. We will not publish information about the currency value of your sales.

Any material you post to the Posse Services (including in a chat, message board or forum) may be publicly displayed and it may not be possible to subsequently delete or remove.

Any material you may have contributed to the Posse Services may remain in some form on the site even after you cease to be a member.

Posse does not sell or share your personal information with other people or companies except where:

  1. you have provided your express consent;
  2. it is made in connection with the provision of the Posse Services pursuant to the Terms and Conditions of Use;
  3. Posse provides the information to trusted affiliates to process information on behalf of Posse, or to billing, customer relations management, credit card, order fulfilment or shipping companies in order to provide goods or services to you. Such partners must process information under agreements to maintain this policy and with appropriate security and confidentiality mechanisms;
  4. Posse is responding to a court order, legal process or enforceable government request;
  5. Posse believes it is necessary to share information in order to investigate or take action in response to illegal activities; fraud or technical or security issues; threats against the rights, property or safety of Posse, its employees, Users or the public; potential or actual violations of applicable terms of service; or
  6. as otherwise required by law.

Posse may share non-personal, aggregate information with third parties which does not personally identify you.

Posse may display advertisements that are targeted based on personal information, including your interactions with this web site. Posse does not provide any personal information to advertisers or advertisement serving companies, but advertisers may collect anonymous information and draw inferences about targeting criteria for a particular ad requested for display to you.

4. Securing your information

Posse employs appropriate electronic and procedural measures to protect personal information from unauthorized access or modification. Access to your personal information is limited to employees we believe reasonably need to use that information in order to perform their roles in providing or developing the Posse Services.
